OVERVIEW

To provide commercial contract management support to EARTH’s internal and external customers that meet RFP/ RFI/RFQ requirements and consistent with Contract Management policy & procedures

Education and Qualifications

Education

  • Minimum bachelor degree in contract management or equivalent

Preferred Qualification

  • Master degree in contract management or equivalent
  • Master degree in business administration (MBA)/bachelor degree in law (LLB) or equivalent

Experience

  • Minimum 10 years of contract management experience in public/private sector organization

Key Accountabilities

  • Provide inputs to develop and implement Contract Management Strategy
  • Provide inputs to develop and implement Contract Management policy & procedures 
  • Assist to develop and implement Contract Management section budget and monitor financial performance against the budget
  • Conduct meetings (in conjunction with Sr. Contract Engineer) with concerned EARTH departments and/or program/ project teams to discuss the customer requirements and/or interpret RFQ/RFP/RFI to gather the technical requirements of the requested services and provide high level risks associated with post-award contract administration
  • Participate as a member in the Tender/Bids Opening, Evaluation and Negotiation Committee and provide Contract life-cycle management support for the projects undertaken by EARTH
  • Analyze the final scope of services and provide contract administration risk and risk mitigation measures specific to commercial aspects
  • Finalize proposal budget estimates and commercial terms & conditions for customer and supplier contracts/agreements in coordination with Program/Project Managers and Finance Department
  • Finalize commercial inputs (in coordination with Sr. Contract Engineer) for contracts and agreements for customers and suppliers including but not limited to NDA’s, Project Agreements, Sale & Purchase Agreements, Licensing Agreements, Supply Agreements, Services Agreements, etc. (as and when required)
  • Conduct (in coordination with Sr. Contract Engineer) meetings with customers and suppliers to negotiate the commercial contract with the concerned Program/Project Managers, Legal Advisor and Finance Department
  • Conduct meetings (in coordination with Sr. Contract Engineer) with Insurance Brokers to review the project specific insurance proposal and quote
  • Coordinate (in conjunction with Sr. Contract Engineer) with Program/Project Managers and Finance Department to finalize the project specific insurance and ensure issuance of insurance certificate before the beginning of the program/project
  • Manage compliance needs of contracts (in coordination with Sr. Contract Engineer) including insurance certificates, authority levels and contract approvals with Legal Advisory Team
  • Monitor the contract performance on commercial aspects (specific to the achievement project milestones) and propose measure/solutions to Program/Project Managers to bridge the performance gaps
  • Inform the Program/Project Managers about a milestone event in advance, prior to the milestone occurrence and advise Finance Department to raise payment request against the completion of milestone 
  • Identify post contract award risks specific to commercial aspects and recommend risk mitigation measures/ solution to Program/Project Managers
  • Finalize responses to customer and supplier regarding contract deviations, modification in proposal budget estimates, commercial terms & conditions
  • Review customer complaints related to commercial aspects of contract, propose corrective actions on non-conformities to Program/Project Managers and ensure its implementation
  • Finalize (in coordination with Sr. Contract Engineer) Quarterly/ Periodically Account Closing of the projects, forecast estimates and communicate them to Program/Project managers
  • Develop and manage key customer and supplier relationships by understanding customer requirements and providing solution to their problems
  • Review (in coordination with Sr. Contract Engineer) supplier performance reports and propose actions to improve the effectiveness and efficiency to improve their services
  • Ensure effective management of all relevant contract related correspondences and documentations
  • Coordinate with the Internal/External Auditors and provide required documents for completion of the internal/external audit, as and when required
